HandicapMD Online Terms of Use

Introduction
Welcome to HandicapMD, a telehealth connection company (“HandicapMD”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our online platforms, including our website, mobile applications, and related services (collectively, the “Service”). By accessing and using the Service, you (“User” or “Patient”) agree to be bound by these Terms.
Ownership and Intellectual Property
The content within the Service, including text, graphics, software, logos, and operational processes and procedures, is the property of HandicapMD or its partners and is protected by U.S. and international copyright and trademark laws. Unauthorized use, including copying, distributing, or modifying any content, is strictly prohibited without HandicapMD’s written consent.
Services Offered
Core Service: Our primary service is facilitating a licensed clinician’s signature on specific DMV forms for the Patient’s respective state. This service is deemed complete upon the Patient receiving the signed DMV form via email provided at checkout.
Optional DMV Form Submission: Subject to eligibility and feasibility based on state-specific regulations and requirements, we may offer assistance with DMV form submissions. This is an ancillary service provided after the completion of the core paid-for service.
DMV Process and Timelines: We have no control over DMV processes and cannot commit to any specific timelines for DMV form processing.
Service Timeline Commitment: Our goal is to provide the clinician’s signature within seven (7) business days from the receipt of all necessary information from the Patient. However, the actual timeline may vary and may take up to sixty (60) business days.
No Direct Medical Relationship
HandicapMD acts as a facilitator connecting Users with licensed healthcare providers. It does not establish a doctor-patient relationship and does not offer medical advice. Users should consult their healthcare provider for medical guidance.
Refund Policy
Refunds are issued only if our clinicians determine a patient is ineligible for our service. Patients must complete the evaluation to be eligible for a refund. Refund requests prior to evaluation or if after evaluation and approved incurs a $50 fee. Refunds can take up to 30 days to process. We are not responsible for disapprovals, fines, fees, or penalties by the DMV or other entities.
User Responsibilities
Users must provide accurate and complete information and comply with state-specific requirements. HandicapMD is not liable for service delays or additional fees due to User non-compliance or incorrect information.
Electronic Communications
By using our Service, you consent to receiving electronic communications from us. These communications satisfy any legal requirements for written communication.
Platform Access and Security
Users are responsible for maintaining the confidentiality of their account information. HandicapMD reserves the right to revoke access at any time without notice for any misuse.
Accuracy of Information
While we strive for accuracy, HandicapMD does not guarantee the correctness or completeness of the Service’s content. Users should inform us of any discrepancies for correction.

Content Submission
Content uploaded by Users should not violate laws or third-party rights. HandicapMD has the right to use, modify, or distribute user-submitted content.
Disclaimer of Warranties
The Service is provided “AS IS” without any warranties, express or implied. HandicapMD does not guarantee uninterrupted access or that the Service will remain operational for any period.
No Medical or Legal Advice
HandicapMD does not provide medical or legal advice or ensure claims regarding laws or regulations. Users should seek professional advice for specific concerns.
Limitation of Liability
HandicapMD and its affiliates are not liable for any damages arising from the use of, or inability to use, the Service or any linked website.
Chargeback and Dispute Resolution
In the event of a chargeback request by a User, HandicapMD reserves the right to present these Terms as a binding agreement to support the legitimacy of the charge. Users agree to resolve any service-related disputes directly with HandicapMD before initiating a chargeback. HandicapMD reserves the right to withhold any aspects of the service, including but not limited to clinician-signed forms, until the dispute is withdrawn.
Amendments to Terms
HandicapMD reserves the right to modify these Terms at any time. Continued use of the Service signifies acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of California.
Entire Agreement
These Terms constitute the entire agreement between the User and HandicapMD regarding the Service.
